Rental & Liability Waiver

Assumption of risk

I (the "Participant") understand that participating in a Polaris Slingshot rental and/or a captained tritoon charter involves inherent risks, including but not limited to: loss of control, rollover, collision, impact with stationary or moving objects, weather-related hazards, mechanical failure, drowning, injury to myself or my fellow passengers, and death. I voluntarily assume all such risks. For the captained boat charter, I acknowledge I ride as a passenger and the licensed captain operates the vessel; I assume the standard passenger risks of motorboat travel on the Gravois Arm of the Lake of the Ozarks.

Release of liability

In exchange for being permitted to rent or charter, I hereby release, waive, discharge, and covenant not to sue Serengeti Rentals, LLC, its owners, employees, agents, captains, representatives, successors, and assigns (collectively, "Released Parties"), for any loss, damage, injury, claim, or demand arising from my use of the vehicle or participation in the charter, INCLUDING claims arising from the ordinary negligence of the Released Parties, to the maximum extent permitted by Missouri law.

Indemnification

I agree to indemnify and hold harmless the Released Parties from any liability, claim, or expense (including attorneys' fees) arising out of my use of the vehicle, my participation in the charter, or my breach of this Agreement, including claims by any passenger or third party brought by or for me.

Rules of use — Slingshot (driver-operated rental)

• Primary driver must be 25 or older with a valid driver's license.
• No operation under the influence of alcohol, cannabis, or other impairing substances. Missouri DWI laws apply. Violation voids insurance and this Waiver.
• No off-road use.
• Do not exceed rated seating (2 occupants) or weight capacity.
• Closed-toe shoes required.
• No smoking in the vehicle.

Rules of participation — Captained tritoon charter

• The licensed captain is the legal operator. Guests do not operate the vessel except briefly at the captain's sole discretion under direct supervision.
• Follow the captain's instructions at all times — they have final authority on weather, course, anchoring, swim stops, and ending the charter early for safety.
• Life jackets worn in designated zones (the captain will direct).
• No Boating Under the Influence by the captain — zero tolerance. Guest alcohol is at the captain's discretion and within MO law.
• Do not exceed rated passenger capacity or weight capacity.
• No smoking on the vessel.

Financial responsibility

I acknowledge that I am responsible for all damage, loss, or theft occurring during the rental period, up to the full replacement value of the vehicle, less any amount paid by insurance. I authorize Serengeti Rentals to charge my credit card on file for damages as documented by photos and a written damage report.

Fuel charges (boat charter)

For the captained tritoon charter, fuel is included in the rate up to one full tank (50 gallons). Typical charter consumption falls well under this cap. If my charter exceeds one full tank, additional gallons are billed at the marina dock price prevailing at the time of refueling, charged to the card on file, and itemized in my post-trip receipt. The vessel is GPS-tracked, and a usage record is available on request.

For the Slingshot rental, the vehicle is provided full of fuel. I am responsible for returning it full, or paying the marina/gas-station price plus a $20 service fee per the rental terms.

Insurance

I understand that my personal auto or watercraft insurance likely does not cover rental or charter participation. Serengeti Rentals carries commercial rental liability insurance for the Slingshot and commercial passenger-vessel coverage for the captained tritoon charter, per the terms of those policies; I understand coverage limits and exclusions apply.

Arbitration

Any dispute arising from this Agreement shall be resolved by binding arbitration in Morgan County, Missouri, under the American Arbitration Association's Consumer Arbitration Rules. I waive any right to a jury trial or class action.

Acknowledgment

I have read this Agreement, had the opportunity to ask questions, and understand that I am giving up substantial legal rights by signing it. I sign voluntarily.
