Rental & Liability Waiver

Assumption of risk

I (the "Renter") understand that operating a Polaris Slingshot three-wheeled autocycle and/or a motorboat involves inherent risks, including but not limited to: loss of control, rollover, collision, impact with stationary or moving objects, weather-related hazards, mechanical failure, drowning, injury to myself or my passengers, and death. I voluntarily assume all such risks.

Release of liability

In exchange for being permitted to rent and operate the vehicle, I hereby release, waive, discharge, and covenant not to sue Serengeti Rentals, LLC, its owners, employees, agents, representatives, successors, and assigns (collectively, "Released Parties"), for any loss, damage, injury, claim, or demand arising from my use of the vehicle, INCLUDING claims arising from the ordinary negligence of the Released Parties, to the maximum extent permitted by Missouri law.

Indemnification

I agree to indemnify and hold harmless the Released Parties from any liability, claim, or expense (including attorneys' fees) arising out of my use of the vehicle or my breach of this Agreement, including claims by any passenger or third party.

Rules of use

• Primary operator must be 25 or older with a valid driver's license.
• No operation under the influence of alcohol, cannabis, or other impairing substances. Missouri BUI (boating) and DWI (driving) laws apply. Violation voids insurance and this Waiver.
• No off-road or off-approved-water use.
• Do not exceed rated seating or weight capacity.
• Closed-toe shoes required in Slingshot.
• Life jackets on all boat passengers in designated zones.
• No smoking in or on any vehicle.

Financial responsibility

I acknowledge that I am responsible for all damage, loss, or theft occurring during the rental period, up to the full replacement value of the vehicle, less any amount paid by insurance. I authorize Serengeti Rentals to charge my credit card on file for damages as documented by photos and a written damage report.

Insurance

I understand that my personal auto or watercraft insurance likely does not cover rental use. Serengeti Rentals carries commercial rental liability insurance per the terms of our rental insurance policy; I understand coverage limits and exclusions apply.

Arbitration

Any dispute arising from this Agreement shall be resolved by binding arbitration in Morgan County, Missouri, under the American Arbitration Association's Consumer Arbitration Rules. I waive any right to a jury trial or class action.

Acknowledgment

I have read this Agreement, had the opportunity to ask questions, and understand that I am giving up substantial legal rights by signing it. I sign voluntarily.
